Terms and Conditions

Welcome to the blendSMART® Asia website, operated by CreaAsia Enterprise Co., Ltd. (hereinafter referred to as the company). In order to ensure the protection of both your interests and those of CreaAsia Enterprise, we ask that you please read and understand the following e-commerce agreement. This agreement applies to all products and services offered on the blendSMART® Asia website (this website) and is referred to as the blendSMART® Asia e-commerce agreement.

By clicking "I agree" or a similar option, or by making an order, payment, or any other related activity on blendSMART® Asia, you are indicating that you have read, understood, and fully accepted the terms of this agreement.

1. User Eligibility

By using any of the services available on this website, you confirm that you have read, understood, and accepted all the terms of this agreement, including any subsequent amendments and changes. If you are under the age of twenty, you must obtain the consent of your legal guardian or representative before using the services of this website. If you have already used this website, it is assumed that you have obtained such consent.

To make purchases on this website, you must first register with a valid email address and set a password. When you save your information on this website for the first time, the system will record your email address and password. You agree to use the same email address and password to make future purchases on this website.

You are responsible for maintaining the confidentiality of your email account and password and agree not to share, lend or transfer your account and password to any third party. You will be held responsible for any actions taken using your account and password.

If you suspect that your email account and password have been used fraudulently, please notify blendSMART® Asia immediately. We will suspend any transactions associated with that email account.

2. Personal Data Security

blendSMART® Asia complies with all relevant laws and regulations regarding the protection of personal data. For more information on our personal data protection and privacy policies, please refer to our privacy statement. To complete transactions, including but not limited to payment and delivery, you must ensure that all information provided during the ordering process is complete, accurate, and up-to-date. If there are any changes, you are responsible for notifying blendSMART® Asia.

blendSMART® Asia has implemented a secure transaction model that ensures the confidentiality of your personal data. We will not disclose any information to any third party other than agents providing related goods or services to complete transactions or provide customer services. Depending on the nature of your transaction, if it involves international shipping, the relevant agencies may be located abroad, and information may be provided to the relevant agents, involving international transmission.

blendSMART® Asia reserves the right to view or provide your personal information to the competent authority or a third party who claims that its rights have been violated and provides appropriate certification under the following circumstances:

• According to laws and regulations, or in accordance with the orders of judicial or other competent authorities;
• To complete the transaction or implement the terms of this agreement, or when you violate the terms of this agreement;
• To maintain the normal operation and safety of the blendSMART® Asia system;
• To protect the legitimate rights and interests of blendSMART® Asia, other users, or third parties.

3. Online Ordering

In addition to the terms of this agreement, the relevant information presented on the product sales webpage and relevant web pages in the order process, including relevant transaction conditions, restrictions, and instructions, are part of this agreement.

In principle, your purchases on blendSMART® Asia e-commerce are provided by blendSMART Asia. However, the information you browse or the purchases made on blendSMART® Asia e-commerce may also be made by a third party. In this case, you are ordering from each of the third parties, or entrusting each of the third parties to fulfill your order, and each of the third parties shall perform the transaction accordingly. blendSMART® Asia only provides marketing services, links, cash flow collection, and its e-commerce platform information processing services.

Once you complete your order on this website in accordance with the methods, conditions, and procedures specified, it means that you have made an offer and are willing to order the goods or services in accordance with the terms of this agreement and the agreed content, transaction conditions, or restrictions stated on the relevant webpage. If your personal information, such as your address and phone number, has changed, you should notify blendSMART® Asia immediately to assist in the relevant processing, and you must not deny the order or refuse the payment on the grounds that the information does not match.

After you complete the online ordering process, the system will automatically send you a notification via email. The notification only informs you that the system has received your order request and does not mean that the transaction has been completed or the contract has been established. blendSMART® Asia reserves the right to accept your order.

If the transaction details are incorrect or the goods are out of stock or the requested service cannot be provided, blendSMART® Asia may refuse to accept the order. You understand and agree that although blendSMART® Asia will do its best to maintain the correctness of the relevant information, blendSMART® Asia does not guarantee in any express or implied manner that all the information displayed on this website is complete, correct, and real-time. Regarding the limit of the order quantity of related goods or services, blendSMART® Asia will only ship according to the limit of the order quantity if the quantity exceeds the order.

If the specifications, pictures, descriptions, prices, or relevant information of the goods or services are incorrect, blendSMART® Asia may refuse to accept your order within two days after you complete the order process. Regarding the goods or services you have ordered, the pricing and payment method of the shipping costs shall be determined according to the records on the relevant web pages.

You can choose the delivery location and method of the goods or services you ordered in accordance with the methods, conditions, and restrictions recorded on the relevant pages of the product or service sales page and the order process.

If the goods or services you ordered cannot be delivered after two attempts and cannot be contacted for more than three days, blendSMART® Asia will cancel the order and refund the full amount if the payment has been made.

4. Return Policy

If the goods you ordered are defective, you have the right to request a full refund in accordance with the Consumer Protection Law. The process and requirements for returns and refunds will be outlined in our return and exchange policy.

Once we receive the returned goods, we will process the refund within 7-14 days, regardless of the payment method. To be eligible for a return, the goods must be in the same condition as received, including all original packaging, accessories, and documentation. If there is a physical invoice, it should be included with the returned goods, failure to do so may result in a refusal of the return request.

Please note that if you request a return or exchange, we reserve the right to not accept your order, or to terminate the contract under certain circumstances. If required by law, we will process invoices or discount slips and other documents on your behalf.

5. Intellectual Property Rights

All software, programs, and content on this website, including but not limited to works, images, files, information, data, website structure, screen layout, and webpage designs, are protected by the company's intellectual property rights under the law, including but not limited to trademark rights, patent rights, copyrights, trade secrets, and proprietary knowledge.

Unauthorized use, modification, reproduction, broadcasting, distribution, publication, reverse engineering, decompilation, or disassembly is prohibited. To quote or reprint any of the aforementioned software, programs, or website content, you must obtain prior written consent from the company or other rights holders in accordance with the law.

Compliance with intellectual property rights is your responsibility. Any violations will result in liability for damages to the company, including but not limited to legal fees and attorney costs.

6. System Security and Backup

blendSMART® Asia takes appropriate measures to protect the security of our systems and the data you upload or transmit through them. However, we cannot guarantee that this data will always be displayed or processed as expected, or that it will be transmitted without errors. If you discover any errors or omissions in our system, please notify blendSMART® Asia immediately.

We regularly perform data backups, but blendSMART® Asia is not liable for any accidental deletion of data, backup errors, or failures, except in cases of deliberate or gross negligence.

7. Interpretation of Agreement

This agreement and related web pages contain terms and conditions that apply to each article and item. If any part of this agreement or related web pages is deemed invalid by a court or does not constitute a part of the contract, it will not affect the validity of the remaining clauses or other agreed-upon content.

Any clauses or agreed-upon content deemed invalid by a court or not constituting a part of the contract shall be interpreted in accordance with the maximum possible scope permitted by relevant laws and regulations and in a manner consistent with the original clauses.

In accordance with Article 11, Paragraph 2 of the Consumer Protection Law, in case of any doubt regarding standardized contract terms, it shall be interpreted in favor of the consumer.

8. Limitations of Liability

You understand and agree that in the event that blendSMART® Asia is liable for compensation to you in accordance with the law or contract for any reason, blendSMART® Asia's compensation or liability shall be limited to the actual amount of the disputed transaction or the maximum liability allowed by law.

9. Governing Law and Jurisdiction

All online orders, transactions, or actions made on blendSMART® Asia, as well as the terms of this agreement and the agreements on the relevant web pages, are governed by the laws of the Republic of China (Taiwan).

All disputes arising from your online order, transaction, or behavior on blendSMART® Asia, as well as the terms of this agreement or the agreements on the relevant web pages, unless otherwise mandated by law, should be resolved through the Taipei District Court of Taiwan as the chosen jurisdiction.
